FMCSA Releases Final Guidelines to Tackle Illegal Brokers in Trucking

The Federal Motor Carrier Safety Administration (FMCSA) has issued final guidelines aimed at curbing the rise of illegal brokers and dispatchers in the trucking industry. The guidelines, developed in response to the 2021 Infrastructure Investment and Jobs Act, clarify FMCSA’s interpretation of truck brokerages and "allocation of traffic" among brokers, dispatchers, and agents. They provide examples of legal brokered loads and stress that entities acting as dispatchers need a broker's license unless working under specific conditions. The Small Business in Transportation Coalition (SBTC) has applauded the move, stating it could be a "death blow" for unlicensed brokers.
